By accessing or using the services provided by Elite Property Management San Diego ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Provided

Elite Property Management San Diego provides professional property management services, including but not limited to:

  • Property marketing and tenant placement
  • Rent collection and financial management
  • Property maintenance and repairs coordination
  • Tenant screening and background checks
  • Lease agreement preparation and enforcement
  • Property inspections and compliance monitoring
  • 24/7 emergency response services
  • Eviction processing when necessary

3. Property Owner Responsibilities

As a property owner using our services, you agree to:

  • Provide accurate and complete information about your property
  • Maintain adequate property insurance coverage
  • Ensure the property meets all applicable housing codes and regulations
  • Authorize necessary repairs and maintenance within agreed-upon limits
  • Pay management fees and other charges as specified in the management agreement
  • Respond promptly to requests for decisions or authorizations
  • Maintain sufficient funds in designated accounts for property expenses
  • Comply with all fair housing laws and regulations

4. Tenant Responsibilities

As a tenant of a property managed by us, you agree to:

  • Pay rent and all other charges on time as specified in your lease agreement
  • Maintain the property in good condition and report needed repairs promptly
  • Comply with all terms of your lease agreement
  • Respect the rights and quiet enjoyment of neighboring tenants
  • Allow access for inspections and repairs with proper notice
  • Use the property only for lawful purposes
  • Provide accurate information during the application process
  • Carry renter's insurance as required by your lease

5. Fees and Payment Terms

5.1 Management Fees

Property owners agree to pay management fees as outlined in their individual management agreement. Fees are typically calculated as a percentage of gross monthly rent collected.

5.2 Additional Fees

Additional fees may apply for services including:

  • Tenant placement and leasing services
  • Property inspection reports
  • Eviction processing and legal proceedings
  • After-hours emergency response (beyond normal scope)
  • Special projects or services not covered in the management agreement

5.3 Rent Payment

Tenants must pay rent by the due date specified in their lease agreement. Late payments may incur late fees as permitted by law and specified in the lease agreement.

6. Termination

6.1 Property Owner Termination

Property owners may terminate the management agreement with written notice as specified in the management agreement, typically 30-60 days. Early termination may result in fees for services already performed or costs incurred.

6.2 Tenant Termination

Tenants may terminate their lease only as permitted under the terms of their lease agreement. Early termination may result in penalties as specified in the lease.

7. Liability and Indemnification

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our liability is limited to the amount of fees paid to us in the preceding 12 months
  • Property owners agree to indemnify us against claims arising from property conditions or owner decisions
  • We maintain appropriate insurance coverage but are not responsible for property damage or loss beyond our control
  • We are not liable for tenant actions or property damage caused by tenants

8. Privacy and Data Protection

We collect and use personal information as described in our Privacy Policy. By using our services, you consent to our collection and use of information as outlined in the Privacy Policy.

9. Compliance with Laws

All parties agree to comply with applicable federal, state, and local laws, including but not limited to: fair housing laws, landlord-tenant laws, building codes, and safety regulations.

10. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation is unsuccessful
  • Binding arbitration or litigation in San Diego County, California

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Entire Agreement

These Terms, together with any management agreement or lease agreement, constitute the entire agreement between you and Elite Property Management San Diego regarding our services.
